Used vehicle terms of purchase
Version 1.0 | November 2026
These terms cover consumer purchases agreed at our premises. Read them with your vehicle sales agreement before buying, particularly the return agreement and cost rules in section 6.
Dealer and return address: Unit 10 Cars Ltd, Unit 10, Cloverlay Industrial Park, Canterbury Lane, Rainham, Kent ME8 8GL.
Website: unit10cars.co.uk.
Company registration and contact details appear on your vehicle sales agreement. Returns are by appointment, without delaying statutory remedies.
1 Your contract
1.1 "We" means Unit 10 Cars Ltd; "you" and "vehicle" mean the customer and vehicle identified in the vehicle sales agreement. Trade purchases require separate terms.
1.2 We provide these terms before you commit. Your order is accepted when we confirm it in writing. The vehicle sales agreement, these terms and any agreed condition record form your contract.
1.3 Record requirements and agreed work in the vehicle sales agreement. Binding descriptions and promises, including oral ones, remain valid. Changes require both parties' agreement and will be recorded in writing.
2 Price and payment
2.1 The vehicle sales agreement records the total price, including taxes and agreed extras or delivery. There is no vehicle purchase administration fee. Optional products require your agreement.
2.2 Cleared payment is required before handover. Ownership passes on full payment, subject to any lender's ownership rights. Risk normally passes when you or your nominated recipient takes possession.
3 Deposits and cancellation
3.1 Deposits count towards the purchase price. The deposit receipt or invoice records the agreed conditions and forms part of your contract, subject to statutory rights.
3.2 On-premises purchases have no automatic change-of-mind cancellation right. If we cannot supply the agreed vehicle and cancel, we refund your payments without limiting further legal remedies.
4 Part exchange and handover
4.1 You must be entitled to sell your part exchange and disclose outstanding finance, ownership claims, known material faults, modifications, accident history and mileage uncertainty. Agreed lender settlements and any equity or shortfall are recorded in the vehicle sales agreement.
4.2 The allowance depends on accurate information and substantially unchanged condition, allowing for agreed use. For a material discrepancy, we will explain the evidence and discuss a revised allowance or purchase without part exchange. If unresolved, either party may cancel. Payments will be refunded, less any lawful claim for proven breach-related loss.
4.3 Collection or delivery is recorded in the vehicle sales agreement. Unless otherwise agreed, delivery is without undue delay and within 30 days of contract. Statutory cancellation rights for missed deadlines remain.
4.4 Arrange insurance and vehicle tax before driving away. We may verify collectors' identity and authority, and record mileage, condition and supplied items at handover.
4.5 Tell us if collection is delayed. Unjustified delay may incur reasonable additional storage losses only after written notice and a reasonable opportunity to collect. No charge applies to our delay or retention required for a statutory remedy.
5 Condition and reporting a fault
5.1 A fault or imperfection does not automatically establish a right to a remedy. Satisfactory quality depends on reasonable expectations for the vehicle's age, mileage, price, description and circumstances. Normal wear and cosmetic imperfections consistent with those expectations do not, by themselves, breach the Act.
However, faults need not prevent driving: appearance, minor defects, safety and durability also matter.
Routine maintenance is yours, but wear does not excuse defects for which we are legally responsible. Specific defects must be disclosed before contract; general condition acknowledgements do not waive rights.
5.2 Report faults promptly using the contact details on your vehicle sales agreement, with registration, mileage, symptoms and location. Written notification is helpful, not compulsory. Stop driving if unsafe or likely to worsen damage, and reasonably limit further loss.
5.3 Allow reasonable inspection and, where legally permitted, repair. You need not accept repair before a valid short-term rejection. Keep relevant reports, invoices and, where practicable, replaced parts.
5.4 Seek approval before commissioning work at our expense. Necessary emergency work and legally recoverable costs remain claimable; lack of approval alone does not defeat a lawful claim.
5.5 Chargeable investigations outside our statutory duties require your prior agreement to scope and price. A complaint does not authorise charges.
6 Express agreement to arrange return
6.1 By signing the vehicle sales agreement incorporating these terms, supplied before you commit, you expressly agree to arrange return to our address above when reasonably required for inspection, repair or lawful rejection.
Timing must be reasonably agreed, subject to clauses 6.2-6.7.
This is an agreement under section 20(7)(b) of the Consumer Rights Act 2015. Simply receiving these terms does not mean you have accepted them.
6.2 Contact us to agree safe return arrangements. Do not drive an unsafe or unlawful vehicle; tell us so transport can be agreed. We will not delay statutory remedies through appointments or transport arrangements.
6.3 Arranging return and paying for it are separate. For valid rejection, we bear reasonable return costs except your costs of returning the vehicle in person to where you originally took possession, under section 20(8) of the Consumer Rights Act 2015. This does not automatically make recovery or transporter charges yours.
6.4 For statutory repair or replacement, we pay necessary costs, including transport, and act within a reasonable time without significant inconvenience. We arrange and pay for collection, recovery or another suitable solution where requiring you to arrange return would conflict with these duties.
6.5 Agree a reasonable transport provider or quote with us where we must pay. We arrange direct payment where needed; advancing costs is not a condition of a remedy. Lack of prior approval does not exclude legally payable costs.
6.6 If you cannot reasonably arrange return, tell us and make the vehicle available for an alternative arrangement. Valid rejection does not depend on our permission or prior return. Logistics do not remove remedies or extend refund deadlines.
6.7 Warranty-only repairs follow the warranty procedure without restricting statutory claims. Goodwill returns require separate agreement.
7 Condition when returning
7.1 Take reasonable care pending return. For rejection or cancellation, return supplied keys, documents and accessories, remove belongings and record mileage and condition. Do not drive if unsafe or likely to worsen damage.
7.2 Ordinary lawful use does not automatically defeat a claim. Damage or missing-item deductions require evidence and legal justification. No blanket valeting, administration or restocking charges, or unlawful deductions, apply to statutory refunds.
8 Statutory remedies and warranty
8.1 Subject to the Consumer Rights Act 2015, remedies include rejection, normally within 30 days after delivery and any required installation or other steps; repair or replacement; and, where applicable, price reduction or final rejection. Agreed repairs can pause the short-term rejection period.
8.2 For repair, replacement, price reduction or final rejection, a fault that makes the vehicle fail to conform to the contract and appears within six months of delivery is presumed to have existed at delivery, unless we prove otherwise or that presumption is incompatible with the vehicle or fault. For the short-term right to reject, you must show that the vehicle did not conform to the contract at delivery; this may include an underlying defect that became apparent later. Mileage alone does not remove your rights.
8.3 Short-term rejection refunds have no deduction for use. Final rejection may permit a reasonable use deduction, even within six months. We explain deductions; no automatic mileage rate applies.
8.4 Rejection refunds are made without undue delay and within 14 days of agreeing entitlement, by the original payment method unless you expressly agree otherwise, without a fee. We will not unreasonably delay assessment.
8.5 Warranty details are supplied separately and recorded in the vehicle sales agreement. Statutory rights are independent: warranty refusal does not decide liability, and you need not exhaust warranty claims first.
9 Complaints and other terms
9.1 Send complaints to our address above or contact details on your vehicle sales agreement. We will investigate and explain our response. Where required, we will identify an appropriate alternative dispute resolution body and state whether we will participate. Regulated finance complaints follow their separate procedure.
9.2 We do not exclude fraud, death or injury caused by negligence, or other non-excludable liability. We are not responsible for reasonably avoidable loss or additional damage from continued use when stopping was necessary. Liability for the original defect and other recoverable loss remains.
9.3 Our privacy notice governs personal information. Unenforceable terms leave the remainder effective where possible. English and Welsh law applies without removing mandatory protections or court rights where you live.
10 Acceptance through the vehicle sales agreement
Signing the vehicle sales agreement incorporating these terms confirms acceptance, including section 6 and its safeguards. No separate acceptance is required. Statutory rights remain unaffected.
We retain the signed vehicle sales agreement and accepted terms version, and provide you with an electronic copy of these terms.
